Terms of Service, Privacy Policy and Acceptable Use Policy of PROTFORGE SL.
Last updated: 26 October 2026
ProtForge is an independent AI engineering consultancy. We provide fixed-price LLM evaluation and hallucination audits, fractional AI architecture, and the building of AI features, including white-label work for agencies. These terms apply to our website and to our services. Our services are for businesses only, not for consumers.
Each engagement is governed by a separate signed statement of work or contract (an "SOW"). If an SOW conflicts with these terms, the SOW prevails. Where the SOW is silent, these terms apply.
Fees, payment dates and expenses are set out in the relevant SOW. Invoices are issued as agreed in the SOW. Taxes are added where applicable.
We treat your data and any non-public information you share as confidential. We use it only to deliver the agreed work and do not disclose it except to subprocessors needed for delivery, or where the law requires. Where we process personal data on your behalf, we do so as a processor under a data processing agreement (see the Privacy Policy). Confidentiality continues after the engagement ends.
Deliverables listed in an SOW are assigned to the client once the client has paid in full. ProtForge keeps all pre-existing tools, code, methods and know-how, and anything we develop independently of the engagement. To the extent such material is included in a deliverable, we grant the client a licence to use it as part of that deliverable.
Large language models can produce errors. Our audits measure how a system behaves on the data and tests we agree on; they do not certify that a system is free of errors, hallucinations or other failures. The client remains responsible for how it deploys and uses its AI systems.
Our total liability for claims arising from an SOW is limited to the fees paid under that SOW in the 12 months before the event that gave rise to the claim. This cap does not apply to gross negligence or wilful misconduct, or to anything the law does not allow to be limited.
Either party may end an engagement as provided in the SOW. If the SOW does not say, either party may end it by written notice if the other party materially breaches it and does not fix the breach within 15 days of notice. On termination, the client pays for work done up to that date. Sections on confidentiality, intellectual property, liability and governing law survive termination.
Spanish law applies. The courts of Barcelona, Spain, have jurisdiction, unless the SOW says otherwise or mandatory law requires another forum.
We may update these terms. The version on this page applies to the website and to any SOW signed after the "Last updated" date.
The website is static. It has no accounts, no forms, no cookies and no analytics or tracking scripts. Our host, Vercel, keeps standard server logs (such as IP address, time and requested page) for security and operation. The site loads its fonts from Google Fonts, so your browser sends a request, including your IP address, to Google's servers.
If you write to us, we process your email address, name and whatever you send, to answer you and to prepare a proposal. The legal basis is our legitimate interest in replying to business enquiries, or steps taken at your request before a contract (GDPR art. 6(1)(f) and 6(1)(b)). We use Google Workspace for email. We keep correspondence as long as needed for the enquiry or engagement, and for the period the law requires after that.
Under a contract, we may process client data, which can include personal data. In that case ProtForge acts as processor and the client as controller, under a data processing agreement (DPA). We process it only on the client's documented instructions.
We share data only with providers needed to run the site and our work: Vercel (hosting) and Google (email, and fonts). Both are in the United States; transfers rely on the EU-US Data Privacy Framework or standard contractual clauses. We do not sell personal data.
Under the GDPR and the Spanish LOPDGDD you may ask for access, rectification, erasure, restriction, portability, and object to processing. Write to guillermollopis@protforge.com. You may also complain to the Spanish data protection authority, the AEPD (aepd.es).
You must not:
We may suspend access to any tool or service we provide if this policy is breached. To report a breach, write to guillermollopis@protforge.com.
